Misclassification Penalties by Country: What It Costs to Get It Wrong

What an employer owes when a contractor is reclassified as an employee, country by country: back pay or contributions, the fine range where one is set in law, and whether criminal liability applies. This restates the consequences already verified in our [contractor vs employee test by country](/guides/contractor-vs-employee-test-by-country) guide, which covers how each country actually makes that decision.

  • Criminal liability applies in 5 of the 16 countries we cover: Germany, Hong Kong, Ireland, New Zealand, Singapore.
  • A stated lookback or limitation period exists in 4: Germany (4 years (30 if intentional)); Ireland (No limit); Netherlands (5 years); Spain (4 years). Elsewhere, our sources don't state one โ€” that's not the same as there being no limit, except where Ireland's is explicitly stated as none.
  • The business bears the cost, not the worker: back-dated contributions or tax, fines, and in some countries personal or director liability on top.
  • Fine amounts are set in law in Malaysia, Poland, Singapore and Spain; most other countries instead charge a percentage of the unpaid tax or contributions.

In most countries the cost of misclassification is purely financial. These are the exceptions, where the law itself describes a criminal offence or the possibility of prosecution, not just a civil fine.

  • Germany: Yes: withholding employees' social security contributions is a criminal offence carrying up to five years' imprisonment or a fine (StGB ยง 266a).
  • Hong Kong: Yes: an employer can be criminally liable, including up to two years' imprisonment (no compensation insurance) or three years' (failure to enrol in MPF).
  • Ireland: Yes: the Code of Practice describes false self-employment as a criminal offence under the Social Welfare Acts, though no imprisonment term is stated.
  • New Zealand: Yes: deliberately avoiding tax by treating an employee as self-employed is illegal and the employer can be prosecuted, as well as fined.
  • Singapore: Yes: a first conviction for unpaid CPF can carry a fine of S$1,000โ€“5,000 per offence and/or up to six months' imprisonment.

How far back an employer can be made to pay matters as much as the penalty itself. Most of our sources don't state a specific limitation period for misclassification; these do.

  • Germany: 4 years (30 if intentional).
  • Ireland: No limit.
  • Netherlands: 5 years.
  • Spain: 4 years.

If the work looks like employment under the local test, the safer options are to employ the person through your own entity or an Employer of Record, which becomes the legal employer and runs local payroll, rather than risk a contractor relationship a regulator later reclassifies.

Several countries offer an official way to check status in advance rather than wait for an audit: Germany's DRV status determination, the UK's CEST tool, the US Form SS-8, and Singapore's and the Netherlands' self-assessment tools. Where one exists, it's listed in the full test by country.

What happens if you misclassify an employee as a contractor?
The employer typically owes the tax, social security or pension contributions that should have been withheld, often with interest, plus a fine where one is set in law. In 5 of the 16 countries we cover (Germany, Hong Kong, Ireland, New Zealand, Singapore), criminal liability can also apply.
Which countries treat misclassification as a criminal offence?
Germany, Hong Kong, Ireland, New Zealand, Singapore, based on the legislation and official guidance we checked. Elsewhere, the consequences described in our sources are civil: back payments, fines and interest, not imprisonment.
Is there a time limit on how far back misclassification claims can go?
Our sources state a specific period for Germany, Ireland, Netherlands, Spain โ€” Germany: 4 years (30 if intentional); Ireland: No limit; Netherlands: 5 years; Spain: 4 years. For other countries, no period is stated in the sources we used, which isn't the same as confirming there's no limit.
Is the fine for misclassification the same everywhere?
No. Some countries set a fine range directly in law (for example Spain's โ‚ฌ3,750โ€“12,000 per unregistered worker, or Poland's PLN 2,000โ€“60,000), while others charge a percentage of the unpaid tax or contributions instead of a fixed fine.
