Belgium bans lending staff to a third party that exercises part of the employer's authority. The main exception is temporary agency work through a regionally licensed agency, and only for one of six reasons, such as replacing an employee, a temporary increase in work or insertion with a view to permanent hiring.

That makes the legal basis the first question for any EOR in Belgium. Employer costs are also high: ONSS contributions, double holiday pay and, for white-collar staff under joint committee 200, a 13th month and automatic indexation.

EOR services in Belgium at a glance

  • The 5 providers shortlisted here publish starting fees of US$199โ€“599 per employee per month (about โ‚ฌ200โ€“โ‚ฌ500 at the US Treasury rate of 30 September 2026).
  • Mandatory employer costs add about 45% on top of a salary of โ‚ฌ66,000.
  • Key issue: Lending staff is banned except through licensed temporary agency work for set reasons.
  • Hiring a team? Compare EOR fees with running your own Belgian company (SRL/BV or SA/NV) in the EOR vs entity calculator.
  1. 1

    Legal basis

Ask whether the provider employs your hire as a licensed temporary work agency, under which of the six reasons, and how it respects that reason's maximum duration.

  2. 2

    Equal pay at the user

A temporary worker's pay may not be lower than a comparable permanent employee's at your company, including benefits such as meal vouchers. Ask how the provider checks this.

  3. 3

    Joint committee and indexation

Ask which joint committee applies, how automatic indexation and the year-end bonus are handled, and whether they're in the quote.

  4. 4

    Notice periods

Belgian notice grows with seniority under a statutory scale. Ask how the provider calculates notice and who pays it.
